Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AduanasFlex by DGNanotech platform ("the Service") provided by DGNanotech, S.A., a company organized under the laws of the Republic of Panama. By creating an account or using the Service you agree to these Terms.

1. The Service

AduanasFlex by DGNanotech is a SaaS platform designed for customs brokers and logistics operators to manage customs procedures, invoicing, refunds, accounting and integrations with third-party services. We may modify, suspend or discontinue features at any time with reasonable notice.

2. Eligibility and account

To use the Service you must be at least 18 years old and have legal authority to bind the entity on whose behalf you register. You are responsible for keeping your credentials confidential and for all activity carried out from your account.

3. Acceptable use

You agree not to: (a) use the Service for unlawful purposes; (b) reverse engineer or decompile the Service; (c) attempt to access another tenant's data; (d) upload malware or content that infringes third-party rights; (e) overload the infrastructure or interfere with other users' use of the Service.

4. Customer data

You retain all rights over the data you upload to the Service ("Customer Data"). You grant DGNanotech a limited, non-exclusive license to host, process and display Customer Data solely as necessary to provide the Service. You are solely responsible for the accuracy, legality and integrity of Customer Data.

5. Third-party integrations

The Service integrates with third-party services, including Google Workspace and other providers of payments, messaging, storage and accounting. Use of these integrations is subject to the terms and policies of each respective provider. DGNanotech is not responsible for failures or changes in third-party services.

6. Intellectual property

The Service, its source code, design, trademarks and all content other than Customer Data are the exclusive property of DGNanotech and are protected by copyright, trademark and other intellectual property laws. No license is granted other than the one expressly granted in these Terms.

7. Limitation of liability

To the maximum extent permitted by applicable law, DGNanotech is not liable for indirect, incidental, special, consequential or punitive damages, nor for loss of profits, revenue, data or use, arising from the use of or inability to use the Service.

8. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Panama. Any dispute arising in connection with these Terms shall be submitted to the competent courts of Panama City, without prejudice to mandatory rights of consumers under their local law.
